The "FOURTEEN"
The Bella Vista Homes Homeowners Association (“BVHHOA”) is an Oregon nonprofit, mutual benefit, corporation with members.
From April to the end of December 2024, fourteen BVHHOA members (the “Fourteen”) were either (1) on the Board, or (2) on the Architectural Control Committee (“ACC”), or (3) on the Carino Committee, or (4) with Southridge Builders.
The Board's minutes for 2024 show that, during 2024, the Fourteen deliberately ignored the condition of Lots 70, 72 and 73, and that they made all their Carino Lane policy decisions by focusing solely on Carino Lane, to the exclusion of Lots 70, 72 and 73.
Specifically, the Fourteen overlooked the visible: (1) subsidence, (2) deep tension cracks, and (3) erosion gullies within Lots 70, 72 and 73; especially those within the Public Utility Easement that is an integral part of Lots 70, 72 and 73, and abuts all of Carino Lane.
The Fourteen, even after they sought professional legal and geotechnical advice, clearly failed in their duty to protect Carino Lane.
The Fourteen failed to prevent the January 2025 collapse of Lots 70, 72 and 73 that took down the SW extremity of Carino Lane.
